hereinafter referred to as the provider, the contract is concluded.

Subject matter of the contract

This contract regulates the sale of services via the provider’s online shop. For details of the respective offer, please refer to the product description on the offer page.

The offers of DPH Drone Services UG are subject to change and non-binding.

Conclusion of contract

The contract is concluded in electronic business transactions via the shop system or via other means of remote communication such as telephone and e-mail. In this context, the offers presented represent a non-binding invitation to submit an offer through the customer order, which the supplier can then accept. The ordering process for the conclusion of the contract includes the following steps in the shop system:

Selection of the offer in the desired specification (size, colour, quantity).

Placing the offer in the shopping basket

Pressing the ‘order’ button

Entering the billing and delivery address

Selecting the payment method

Checking and processing the order and all entries

Press the ‘order’ button

Confirmation e-mail that the order has been received

In addition to the shop system, orders can also be placed by means of remote communication (telephone/e-mail), whereby the ordering process for the conclusion of the contract includes the following steps:

Calling the order hotline / sending the order email

Confirmation e-mail that the order has been received

The contract is concluded when the order confirmation is sent.

Duration of the contract

Subject to termination, the contract has a term of 1 delivery. For the product “Online course drone licence”, the examination must be completed within 12 months of purchase.

Prices and refunds

The current prices of DPH Drone Service UG at the time of the conclusion of the contract apply. The statutory value added tax is not included in our prices; it will be shown separately at the statutory rate on the day of invoicing. If the goods are purchased via the shop system, the sales tax is added to the net price and is thus included.
After receipt of the invoice and provision of the service by DPH Drone Services UG, the invoice amount owed is due within fourteen (14) days and is payable without further deduction.
The customer has a 30 day money back guarantee. This means he can ask for a refund of the full amount without having to give a reason.

Terms of payment

The customer has only the following options for payment: payment service provider (PayPal), credit card. Other payment methods are not offered and will be rejected.

The invoice amount is to be transferred in advance to the account indicated on the invoice after receipt of the invoice, which contains all details for the transfer and is sent by e-mail. If a trustee service/payment service provider is used, this enables the provider and customer to process the payment between themselves. The escrow service/payment service provider forwards the customer’s payment to the provider. Further information is available on the website of the respective escrow service/payment service provider. The customer is obliged to pay or transfer the stated amount to the account indicated on the invoice within 10 days after receipt of the invoice. Payment is due without deduction from the date of the invoice. After expiry of the payment deadline, which is thus determined by calendar, the customer is in default even without a reminder.

Cancellation policy for goods

Right of withdrawal

You have the right to cancel this contract within thirty days without giving any reason. The revocation period is thirty days from the day on which you or a third party named by you, who is not the carrier, take delivery of the goods.

To exercise your right of withdrawal, you must inform us (DPH Drone Services UG (haftungsbeschränkt), Jasper Heyden , Schwedter Straße 249, 10119 Berlin, Germany, jasperheyden@dronesperhour.com, phone: 030 24033825) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of the revocation

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

The right of withdrawal shall also expire in the case of a contract for the supply of digital content not on a tangible medium if we have commenced performance of the contract after you have expressly consented to us commencing performance of the contract before the expiry of the withdrawal period and have confirmed your knowledge that by consenting you lose your right of withdrawal on commencement of performance of the contract.

You have the right to cancel this contract within thirty days without giving any reason. The withdrawal period is thirty days from the day of the conclusion of the contract.

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of the revocation

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

The right of withdrawal will expire prematurely if we have fully performed the service and have only started to perform the service after you have given your express consent to this and at the same time confirmed your knowledge that you will lose your right of withdrawal upon full performance of the contract by us.

Intellectual property

DPH Drone Services UG remains the owner of the intellectual property rights to the learning materials. This includes the rights to texts, photographs, film recordings, documentation, drawings, lists, illustrations, know-how, and all other results delivered to the customer.

DPH Drone Services UG grants its customers a simple and unlimited right of use within the scope of the respective individual order to the aforementioned intellectual property rights, in particular copyrights. Any transfer to third parties may only take place with the written consent of DPH Drone Services UG.

Exclusion of liability

Claims for damages by the customer are excluded, unless otherwise stated in the following. This also applies to the representative and vicarious agents of the provider, if the customer asserts claims for damages against them. Excluded are claims for damages of the customer due to injury to life, body, health or essential contractual obligations which must necessarily be fulfilled in order to achieve the objective of the contract. Likewise, this does not apply to claims for damages following grossly negligent or intentional breach of duty by the provider or his legal representative or vicarious agent.

Language, place of jurisdiction and applicable law

The contract shall be drawn up in German. The further performance of the contractual relationship shall be in German. The law of the Federal Republic of Germany shall apply exclusively. For consumers, this shall only apply insofar as this does not restrict any legal provisions of the state in which the customer is domiciled or habitually resident. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law is the registered office of the provider.

Dispute resolution

Data protection

In connection with the initiation, conclusion, processing and reversal of a purchase contract on the basis of these General Terms and Conditions, data is collected, stored and processed by the provider. This is done within the framework of the statutory provisions. The Provider shall not pass on any personal data of the Customer to third parties unless it would be legally obliged to do so or the Customer has expressly consented to this in advance. If a third party is used for services in connection with the handling of processing operations, the provisions of the Federal Data Protection Act shall be complied with. The data provided by the customer by way of the order shall be processed exclusively for the purpose of contacting the customer within the framework of the processing of the contract and only for the purpose for which the customer has provided the data. The data will only be passed on to the shipping company that takes over the delivery of the goods according to the order to the extent necessary. The payment data will be passed on to the credit institution commissioned with the payment. Insofar as the provider is subject to retention periods under commercial or tax law, the storage of some data may last up to ten years. During the visit to the provider’s Internet shop, anonymised data that do not allow any conclusions to be drawn about personal data and do not intend to do so, in particular IP address, date, time, browser type, operating system and pages visited, are logged. At the request of the customer, personal data will be deleted, corrected or blocked within the framework of the legal provisions. Free information about all personal data of the customer is possible. Severability clause

The invalidity of any provision of these GTC shall not affect the validity of the other provisions.
